Terms and Conditions

1. Company Scope

• Planning and construction of residential housing projects.
• Sale and transfer of flats and residential units.
• In-house and outsourced marketing activities.

2. Eligibility

• Only individuals who are 18 years or older
• Legally competent to enter into contracts are eligible to purchase or book property through Navkar.

3. Project Specifications

All project details including layout plans, carpet area, amenities, and possession timelines are as per MAHARERA-registered documents.

Visuals used in marketing (brochures, videos, website) are for representation purposes only. Final delivery may vary due to regulatory, design, or execution reasons.

4. Booking Process

• A unit is considered booked only upon receipt of the prescribed booking amount and issuance of a formal booking confirmation.
• Booking is subject to realization of payment and timely submission of required documents (KYC, PAN, Aadhaar, etc.).
• Navkar reserves the right to cancel any provisional booking if formalities are not completed within the given time.

5. Pricing and Payments

• Prices quoted are subject to change without notice prior to booking.
• GST, stamp duty, registration fees, and any other statutory levies are payable separately by the buyer.
• Payment schedules shall follow the agreed milestone-based plan, as per RERA norms.
• Delayed payments may attract:
  • Interest as per the agreement for sale.
  • Holding back of further construction activities related to the booked unit.
  • Possible cancellation, with deductions.

6. Agreement for Sale

Upon booking confirmation, an Agreement for Sale will be executed under the Maharashtra Real Estate Regulatory Authority (MahaRERA) guidelines.

Failure to execute this agreement within the specified period may result in cancellation or revised pricing.

7. Possession and Handover

Possession shall be offered on or before the date specified in the registered Agreement, subject to:

• Full payment clearance,
• Statutory approvals,
• Final inspection and issuance of Occupation Certificate (OC).

8. Cancellation and Refund

Cancellation by the client after booking may result in forfeiture of part or full booking amount, depending on the stage of construction and administrative costs incurred.

Refunds, if applicable, will be processed within a reasonable timeline post verification and approval.

9. Modification & Changes

• No structural or major design changes in the unit will be permitted once construction begins.
• Minor customizations (electrical points, tiles, fittings) may be accommodated within specific timelines and subject to additional cost.

10. Marketing & Promotions

• Navkar reserves the right to use project visuals, client testimonials, or milestone events in social and digital media promotions.
• Offers, schemes, and discounts are time-bound and may vary across projects and stages. These cannot be clubbed unless specified.

11. Force Majeure

Navkar shall not be held liable for delays or non-performance due to factors beyond its control, including but not limited to:

• Changes in law or governmental regulations
• Pandemic/epidemic conditions
• Natural disasters or acts of God
• Shortage of materials or labor unrest

12. Legal Jurisdiction

All transactions and disputes shall be governed under the laws of India. Jurisdiction for any legal proceedings shall lie exclusively with courts in Mumbai, Maharashtra.

13. Limitation of Liability

Navkar’s liability is strictly limited to the obligations outlined in the Agreement for Sale. The company shall not be liable for:

• Investment losses,
• Third-party disputes,
• Market fluctuations post-purchase.

14. Data Usage & Privacy

By interacting with us (online or offline), you agree to our Privacy Policy and allow Navkar to use your information for:

• Service communication,
• Project updates,
• Marketing campaigns and post-sale engagement.
